MEI DATA PRIVACY STATEMENT

MILLENNIUM ENRGY, INC. (MEI) and its subsidiaries PANASIA ENERGY, INC. (PEI), MILLENNIUM POWER RES, INC. (MPRI) and POWER DYNAMICS O & M SERVICES, INC. (PDOM) are committed to maintaining the privacy of data obtained
in the course of its business.

This Privacy Statement, referred to as “STATEMENT” explains how we collect, protect, use, process and share personal information, processes and contents obtained or made available through the MEI Company website, in accordance with
the minimum standards, as defined in the Data Privacy Act of 2012 (RA 10173), and the Personal Data Privacy Policy of the Company and its subsidiaries.

The Company’s Privacy Practices:

The Company’s Privacy Practices will apply to persons in the Philippines, mainly intended to comply with the Data Privacy Act of 2012 (RA 10173).
As a customer, client, applicant or employees who provide personal information, including sensitive personal information, to the Company, it is understood that authority and consent to the collection, use, processing and transfer of said information has been given, in accordance with valid and legitimate purposes. The same includes authority to
share said information with regulatory bodies and government agencies, in accordance with the compliance requirements of the Company and its subsidiaries.

The Company commits to maintaining the integrity, availability and confidentiality of said information against violation incidents or breaches, while maintaining the protection of privacy. Said commitment applies to all employees, officers, directors and customers/clients of the Company. Processing of information, obtained personally or through the MEI Company website, will be pursued with due regard to applicable laws and regulations, including every person’s right to privacy of information. Any transfer or sharing or outsourced processing of information will be carried out in compliance with Philippine laws and regulations, including the Company’s Data Privacy Policy.

Collection of Information or Data:

When one applies for any position, or interacts with the Company’s employees, authorized representatives, agents, or service providers/third party contractors, the following information may be collected:

  • Name and other personal circumstances;
  • Specimen signatures;
  • Government ID details;
  • Financial information;
  • Employment details;
  • Business interests and assets;
  • Images via CCTV and other similar recording processes and devices;
  • Voice recordings of conversations

The Company may choose to seek or verify the above information with third party entities and/or government regulators, judicial and quasi-judicial bodies, tax authorities or courts within Philippine jurisdiction, to gain additional information, if necessary.

The Company may also collect, use and keep personal opinions or comments made known via feedback or replies to surveys or any other interaction made with its employees, authorized representatives, agents or service providers.

Content and Use of Data or Information, and Restrictions:

As a client, customer or employee who provide personal information, and sensitive personal information to the Company, or any of its subsidiaries, it is understood that he/she authorizes and consents to the collection, use, processing and transfer of said data information in accordance with valid and legitimate purposes.

Any and all information that may be obtained from the MEI website will be considered as property of the Company. MEI will be free to use the data or information for any purpose, including any idea, concept, knowhow or technique contained in the said information.

Once the client or customer posts ay content in the MEI Company website, it is understood that he or she grants permission to the Company to access and use it in connection with its main business of power generation.

In connection with the posted comments, the client, customer, applicant or employee agrees to the following:

  • He/she will not submit material that is copyrighted, protected by trade secret or subject to third party proprietary rights, including privacy and publicity rights, unless with permission from the owner.
  • He/she will not post or publish falsehoods or representations.
  • He/she will not post or publish information or contents that are unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, and encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.
  • Reference to political activities, political party meetings, demonstrations, fliers or
    petitions, or propagation of political symbols is prohibited.
  • Posted contents that insults, belittle or negatively affect other users is prohibited.

The Company is authorized to delete, without notice, any posted material in the Company website which are violated of the above-mentioned restrictions.

Personal information collected through the Company website, may be used by the Company for the following purposes:

  • Approve, facilitate, administer, and process applications and transactions;
  • Respond to queries, request or complaints, and improve interaction;
  • Perform profile analysis or behavioral modelling to understand needs and preferences;
  • Perform certain protective safeguards against improper use or abuse of the Company’s information, services, including fraud prevention;
  • Comply with the Company’s operational, audit, administrative, credit and risk management processes, policies and procedures, and other legal and regulatory requirements of government regulators, judicial and quasi-judicial bodies and agencies;
  • Perform legitimate business purposes, consistent with the standards prevailing in the energy industry, and as approved by pertinent government agencies such as the Department of Energy (DOE) and the Energy Regulatory Commission (ERC).
  • Perform other activities allowed by laws and regulations, or upon the consent of the concerned person.

Sharing of Information:

The Company may share personal information it has obtained through the Company Website, or otherwise, to its subsidiaries, affiliates, and even third parties under an obligation of confidentiality.

Disclosures may be made to appropriate government or regulatory authorities, in compliance with legal, judicial or quasi-judicial requirements, inclusive of court orders. Disclosure of personal information may also be made to address any fraud, security or technical concerns, to respond to any emergency, especially in the energy industry, or otherwise, to protect the rights, property or security of the Company’s customers or third parties.

Protection of Information:

The Company fully recognizes the value of personal information obtained through the Company website or otherwise. Hence, it always strives to maintain the confidentiality, integrity and availability of personal information by employing physical, technological and procedural safeguards. The Company’s employees, especially the IT and HR departments, have the responsibility of ensuring the protection of personal information against any unauthorized or accidental access, processing, erasure, loss or use.

Retention and Disposal of Information:

Personal information will be retained for as long as the purpose for which it was gathered, or any other purpose to which consent was duly given, remains in effect, until such time that it is no longer required or necessary to keep said information for any other legal, regulatory or business purposes.

The IT Department of the Company, with the assistance of the HR Department, has the main responsibility of ensuring that files containing personal information are properly disposed of.
